Terms and Conditions
§ 1 Scope
These terms apply to all orders placed via prohandstand.com between ProHandstand, LLC, 1309 Coffeen Ave Ste 2966, Sheridan, WY 82801 (“we”) and our customers (“you”).
§ 2 Conclusion of contract
The presentation of the product on the website is not a legally binding offer but an invitation to order. Clicking “Pre-order now” takes you to the checkout of our payment provider Stripe, where you can review and correct your details before submitting. By clicking the final order/payment button you submit a binding offer to purchase. The contract is concluded when we confirm your order by email (order confirmation).
Contract languages are German and English. We store the contract text; you receive the order details and these terms in text form with the order confirmation.
§ 3 Pre-order and delivery time
The product is sold as a pre-order. Delivery takes place within 4 weeks of the conclusion of the contract. If we cannot meet this deadline we will inform you without delay. You may then withdraw from the contract; any payments already made will be refunded in full without delay. Your statutory rights remain unaffected.
§ 4 Prices and shipping costs
All prices include statutory VAT. Any shipping costs are shown in the checkout before you complete your order.
§ 5 Payment
Payment is made via Stripe using the payment methods offered there. The purchase price is due immediately upon conclusion of the contract (prepayment).
§ 6 Retention of title
The goods remain our property until paid in full.
§ 7 Right of withdrawal
Consumers have a statutory right of withdrawal. See the withdrawal policy, where you can also declare your withdrawal online.
§ 8 Warranty
Statutory warranty rights apply.
§ 9 Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under mandatory product liability law and to the extent of any guarantee given. In the event of a slightly negligent breach of an essential contractual obligation, liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.
§ 10 Safety
Please read the enclosed manual before first use and follow the training routine and safety instructions described there.
§ 11 Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 12 Final provisions
The laws of the State of Wyoming, USA, apply, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory consumer protection provisions of the country of their habitual residence.
